“Unlawful Intrusion” Claim by Kames Retracted by Fish Farmer – “this amendment is temporary while I look into the matter”

I took issue with the use of the phrase "unlawful intrusion" and asked Fish Farmer to retract the false comment by Kames Fish Farming:

Please retract publication of the "unlawful intrusion" comment in the statement by the spokesperson from Kames.  It is false, baseless and libellous.
 
What law is Kames relying upon?  If Kames cannot provide evidence of "unlawful" activity – and cite the relevant legislation which their claim relies upon – then please retract their false comment.

I presume you’ve looked into the legal status of structures at sea –  as the right to roam law doesn’t apply to farm or other buildings (or presumably boats at sea), on the face of it accessing a fish farm without the owner’s permission would at least constitute civil trespass, surely? Ie unlawful but not criminal?

Also on the topic, are you able to say what measures you take to ensure that your filming missions don’t endanger the fish through, for example, exposing them to pathogens you may have brought in from another farm?

Just to be clear, this amendment is temporary while I look further into the matter. Note that the quote from Kames referred to ‘unlawful” not ‘criminal’. I see that you have already quoted our ‘retraction’.
